    Introduction

    For the purpose of the following terms and conditions, the phrases “we” and “us” refer to Linthorpe Bed Centre Ltd, owner of the brand Linthorpe Beds and www.linthorpebeds.co.uk. The term “you” refers to users of this website and customers who have made a purchase with us.

    The term “Goods” means all products listed in your order.

    The terms “Made to measure” or “Custom” means any goods that are made to specific specifications or non-standard dimensions as determined by you.

    By using this website or carrying out a purchase with us, you are fully accepting any terms, conditions and disclaimers contained within this notice. If you do not agree with any part of these terms, you should stop using the website immediately and refrain from ordering any goods. Orders placed by telephone are also bound to these terms and conditions.

    We reserve the right to amend our terms and conditions at any time and without notice.

    The Order

    The quantity and description of the goods you have ordered are set out in your customer order. Please check these details are correct. If you are uncertain about the order details, please contact us for clarification. It is this order which forms our contract with you. We will endeavour to give accurate lead times for products ordered, however factors outside of our control sometimes affect the quoted dates. Once the goods have been ordered it may not be possible to alter the specifications of the order that has been placed. Goods are sold on the understanding that there may be very minor variations to what is stated on product specifications and colours. Photographs of products should be considered as illustrations and any icons used to illustrate colour choices, storage configuration or any other icons are to be treated as representative only, not exact depictions.

    Where imperial measurements are used, these are given as an approximate guide only as some goods are manufactured to their metric equivalent. Product sizes may vary slightly from their stated dimensions due to manufacturing tolerances. Whether the product is made to a standard UK size or purchased as 'made to measure', bear in mind that there may be up to an inch and a half (3-4cm) difference on either width, length or depth. This is to be expected with any products handmade from soft materials and many individual component parts, and this is not considered a manufacturing fault.

    Where information is given regarding the 'feel' or 'tension' of a mattress, this is meant as a rough guide only. How a mattress feels is purely subjective and differs from person to person, depending on height, weight and body shape. We cannot accept items back on the basis that you disagree with the advice stated and you do not find the product to your comfort level.

    Goods listed as a 'Divan Bed' or 'Divan Set' do not include a headboard as standard, unless clearly stated on the order.

    It is generally recommended to unroll a vacuum sealed mattress within 72 hours of receiving it, but no later than 2 months. After this time, the mattress may start to lose its shape, become less comfortable and could void your guarantee/warranty.

    Please note that some mattresses may have a noticeable smell upon being unwrapped due to the manufacturing and packaging process, this is completely normal. Allowing the mattress to air out in a well-ventilated room will help the odour dissipate within a few days.

    Standard Products

    When converted, metric and imperial sizes are not exact. For the purposes of the product we sell, we consider standard sizes to be as follows:

    Goods made to dimensions outside of these sizes are 'made to measure' or 'custom' and the appropriate terms will therefore be applied.

    Standard products refer to all goods which we keep in stock, which are not tailored to your specifications, be that in size, dimension or colour.

    Title And Risk

    Up until the point of delivery all goods are the property of Linthorpe Bed Centre Ltd. Once goods have been signed for and left at an address, it is agreed that they have been received in a satisfactory condition and the signature obtained acts as proof of delivery. From this point the goods belong to the customer and any future damages (not pertaining to a manufacturing fault), are your responsibility.

    Payment

    Any goods ordered from us must be paid for in full before they will be dispatched for delivery. Card payments are accepted for online purchases through a secure transaction via PayPal direct payments (a PayPal account is not required), alternatively you can complete your transaction via a secure external page provided by PayPal which provides our Pay in 3 options. Orders processed over the phone will be sent a payment link via email (we are unable to accept card payments over the phone for fraud prevention and security reasons). Alternatively, phone orders can be paid by bank transfer though this may result in a delay to your order. No information is stored.

    As 3D Secure is controlled by Visa and MasterCard the following cards can be used: Visa, Visa Delta, Mastercard & Mastercard Debit.

    Access

    Please ensure the access route to the property is suitable regarding the size of the goods which are to be delivered, considering any features such as doorways, gates, stairs etc. It is your responsibility to ensure the route is clear and there are no obstructions, we cannot be held accountable for damage sustained due to negligence.

    Our 'Standard Delivery' will only cover delivery of goods to the entrance of a property. Depending on which items you order, additional services may also be included, but this may vary depending on the specific products ordered. We do not offer these additional services on all goods.

    With certain orders, goods are placed in a room of choice on the delivery premises, provided that there are no obstructions. The route from the delivery vehicle to the chosen room must be clear and there must be suitable space for the goods to be left. It is your responsibility to ensure that the route is free from any items which may be easily damaged during the delivery process.

    Please ensure that the access route is suitable regarding the size of the goods which are to be delivered as well, including any features such as doorways, gates and staircases etc. If the goods cannot pass through to the desired room, you will not be eligible for a refund on this basis.

    If an elevator is unavailable, deliveries will be carried no higher than up two flights of stairs.

    It is your responsibility to ensure the goods will fit into the property, whether that be in the room of choice, or fit through your access way.

    Free Delivery Terms

    Delivery is free of charge on all items unless otherwise stated. There may be extra charges for additional services in some instances, which include Express Delivery, Saturday Delivery, and delivery outside of our standard coverage.

    Delivery

    We can deliver to most postcodes in mainland England, Wales and Scotland (including the Highlands & Grampians), but we may be unable to deliver to some locations due to the limitations of our third-party courier services. We are unable to deliver to Ireland (including Northern Ireland) and all offshore islands including the Isle of Wight and Isle of Man. We reserve the right to recover all costs for orders processed to these areas. Please contact us for more details.

    Deliveries to the following postcodes may take longer than the quoted lead time- AB, DD, FK, IV, KW, KY, P, PA and PH. Delivery to these postcodes may also be subject to an additional delivery surcharge.

    As standard we only offer Free Delivery to addresses in mainland England, Wales & The Scottish Lowlands, the definition of which is set by the 3rd party transport companies we use. Please see the available options at the checkout for deliveries to other areas of the UK, along with the associated charges. In some instances, you may be unable to place your order directly online and will instead need to place your order with us over the phone.

    Standard delivery is between the hours of 7am and 7pm on the date of delivery.

    Please ensure you provide a complete and correct delivery address and phone number, and that access is available on the date of delivery, if you are not present at the stated address upon delivery, a charge of £75 will be incurred for re-delivery.

    You must notify us at least 72 hours prior to delivery of any amendments. Any amendment however small may lead to an increase in lead-time or change of delivery date and may incur a charge.

    Please check your goods thoroughly on delivery for damage. If upon delivery you find your goods to be damaged, this must be stated at the time of delivery.

    Disposal

    Disposal of your old goods is not part of our standard delivery service. The service must be arranged in advance and items must be dismantled and prepared for collection. We only provide disposal for goods on a like for like product, be that of size or product type.

    Our disposal service is at charge of £25 for selected mattresses and £50 for divan bases on goods which are applicable. This service can be chosen by selecting the recycling option during the checkout process and the charge will be added to the total order value.

    Be advised that the disposal service is not available for our rolled mattresses. This limitation is due to logistical considerations, as mattress disposals need to be arranged in a like-for-like manner to ensure compatibility with our van capacity.

    If the disposal option is not presented during checkout or you wish to add disposal after placing your order, please contact us as soon as possible and where possible we can arrange to add this to your order. Please note that this may incur costs in addition to those stated above.

    We understand the importance of eco-friendly initiatives and encourage you to explore alternative methods for recycling or disposing of your rolled mattresses responsibly. Please contact your local council as most do offer a mattress disposal service.

    Returns - First 14 Days

    For most products bought online or over the phone, you have a legal right to cancel your order within 14 days of the day you receive the products and receive a refund. stipulations to the right to cancel are in respect of products sealed for health and hygiene purposes. Once these goods have been unsealed after you receive them (whether that be divan bases, mattresses, pillows, or protectors etc) you will waive your right to cancel and return these goods.

    Made to measure or custom goods (all sizes not detailed under the 'standard sizes' section of these terms) including product made in specific fabrics which we do not hold in stock, cannot be cancelled once we (or our suppliers) have commenced work on the production of these goods.

    If you cancel your order after the goods have been dispatched or refuse delivery, unless goods are defective (please see below for process to follow), you are responsible for arranging the return of the goods, covering all costs incurred. Alternatively, if the goods are returned with the courier as supplied by us, you will incur the charge of the return of the goods at a cost of £75 per item. This returns charge will be deducted from any funds owed to you. Once goods are returned to us, we will carry out a full inspection to ensure that the goods are returned “as new”. Goods which have been damaged on return will not be eligible for a refund. We cannot be held responsible for any damages or articles lost via the means in which you have returned the goods to us.

    Providing goods are eligible following these checks, you are entitled to receive a refund within 14 days of us receiving the returned goods.

    Returns - Defective Products

    Any goods which are returned due to being damaged or defective, pertain the same consumer rights as stated above. Prior to processing a damaged/disputed goods claim, we would require a photograph or video evidence of the damaged/defective goods, clearly showing the fault before any action can be processed. We reserve the right to provide an exchange of the damaged goods and Linthorpe Beds will cover the costs of having the goods replaced. In some circumstances, a technician may be sent to complete repairs.

    Goods which have been delivered to you via a 3rd party transport company should always be checked for signs of damage before you sign and accept them. In the case that damage is present you should either a) reject the delivery or b) report the damage on the delivery note as you sign for the goods. Failure to follow this procedure may invalidate your claim for replacement goods.

    We cannot accept returns or refunds based on the grounds of comfort or firmness as these are a personal preference and ratings should be considered as a guideline only.

    Unforeseen Circumstances

    We will not be accountable for situations where we are unable to carry out our obligations due to reasons beyond our control. These include, but are not limited to:

    • delays caused by one of our suppliers or transport companies
    • strikes, lock outs or other industrial action
    • extreme weather or natural disasters
    • any other extenuating circumstance

    In these circumstances we will make every effort to notify affected parties and make alternative arrangements, delays due to unforeseen circumstances may not be eligible for refund or compensation.

    Inaccuracies

    The information contained on this website is accurate to the best of our knowledge. Goods are sold on the understanding that there may be very minor variations to what is stated in product specifications and the colours represented in accompanying images. Icons used to illustrate colour choices, or storage configurations, are to be treated as representative only, not exact depictions.

    Where imperial measurements are used these are given as an approximate guide only as some goods are manufactured to their metric equivalents and are correct according to the manufacturer's specifications.

    Occasionally, manufacturers may change the fabric used for mattress covers without prior warning. This may mean that the fabrics depicted differ from what you receive and is not perceived to be a manufacturing fault or defect as this will not affect the quality, durability or internal structure of the product.

    We do our best to update information in line with changes made by manufacturers. All details, specifications and prices are accurate at the time of publication but may subsequently change and we reserve the right to alter specifications based on manufacturers advice.

    Goods listed as a 'Divan Bed' or 'Divan Set' do not include a headboard as standard, even if one is depicted in the photograph. These goods are comprised of a divan base and mattress only. In addition, pillows, cushions, bedside tables, and other forms of bedding or furniture are also not included (unless otherwise stated).

    We reserve the right to cancel any orders (and refund the transaction) where a pricing error has occurred. We may choose whether to honour these orders at our discretion.

    Responsibility for checking dimensions of your bed or mattress lies with you. Linthorpe Beds cannot be held responsible for you ordering the incorrect size or not checking the dimensions of the goods or the space in which the goods are to be situated prior to purchase.

    Many branded products are sold via this website. Any images, logos and trademarks associated with these products are the sole property of their respective companies.
